Tammy D. McCutchen

Ms. McCutchen represents and counsels management clients in connection with all types of labor and employment matters arising under federal and state law. As a former Administrator of the Wage and Hour Division of the U.S. Department of Labor, Ms. McCutchen is a leading authority on federal and state wage and hour law. She focuses her practice on auditing and correcting wage and hour compliance issues She assists clients to implement compliance programs designed to avoid wage and hour disputes and lower potential litigation liabilities. In addition, Ms. McCutchen represents and counsels clients on the Family and Medical Leave Act, reasonable accommodation under the Americans with Disabilities Act, federal and state discrimination laws, and the affirmative action and prevailing wage requirements for government contractors. Ms. McCutchen represents clients before state and federal courts, the Equal Employment Opportunity Commission, the U.S. Department of Labor, and state agencies.

As Administrator of the Labor Department’s Wage and Hour Division from 2001 to 2004, Ms. McCutchen was responsible for enforcing some of the country’s most comprehensive labor laws, including the Fair Labor Standards Act, the Family and Medical Leave Act, and the Davis-Bacon Act. She managed an annual budget of $160 million and 1,400 employees, represented by two unions, in more than 250 offices across the country. Ms. McCutchen was a primary architect of the first major changes to the DOL overtime regulations in 50 years. Under her leadership, the DOL increased enforcement by 60% while in two years, collecting more than $212 million in back wages for 342,000 employees in 2003.

Before her work at the Department of Labor, Ms. McCutchen was Senior Counsel at Hershey Foods Corporation, where she provided counseling on labor and employment matters involving Hershey’s employees at corporate headquarters, field sales offices, and manufacturing plants located in the United States, Canada and Mexico. She was responsible for managing employment litigation, advising Hershey on collective bargaining and labor arbitration issues, managing the preparation and implementation of Hershey’s Affirmative Action Plans, providing assistance to Hershey’s Diversity Council, and conducting training for managers on recognizing and responding to discriminatory harassment. Following law school, Ms. McCutchen clerked for Judge Daniel A. Manion on the U.S. Court of Appeals for the Seventh Circuit, and practice law in Chicago for eight years.

Ms. McCutchen was ranked in the 2006 edition of Chambers USA: American’s Leading Lawyers for Business annual as a leading employment attorney in the District of Columbia.

Lisa Schreter, Esq.

Ms. Schreter represents and counsels management clients in connection with all types of labor and employment matters arising under federal and state law. Ms. Schreter regularly appears before federal and state agencies and courts in various wage related and equal employment disputes. She has argued appeals in the United States Circuit Courts including the Second, Third, Fifth, Sixth and Eleventh Circuits. In each of these cases, the Courts affirmed the lower court's decision for the Defendants. Ms. Schreter concentrates in representing employers in complex class and collective actions involving overtime and other wage-related claims. Her practice also specializes in assisting employers in developing forward thinking compliance measures designed to reduce wage and hour disputes.

Ms. Schreter has represented management in employment discrimination and wage-related matters since 1991. Prior to becoming an attorney, Ms. Schreter was a human resource executive with extensive experience in wage-hour issues, employee relations, salary and benefit administration, and general employment matters.
