The Immigration Revolution –Strategies for Navigating the System and Retaining Foreign National Staff

 

Immigrants comprise a large portion of the U.S. workforce and serve in critical roles in many U.S. companies. Recent Immigration Law developments have left many in fear of losing their most talented foreign workers.

Retaining talented foreign national staff often requires navigating the immigrant visa sponsorship process. PERM , the Department of Labor's new system for securing permanent residence for immigrant workers, has been up and running since March 2005. But as many HR managers already know, navigating the PERM labyrinth can be more than challenging. This presentation will provide an overview of PERM , focusing upon ways to develop strategies for managing a successful PERM program, thus retaining your workers.

Many employees have also had cases pending for years with the Department of Labor and/or US Citizenship and Immigration Services. They wonder if there is light at the end of the tunnel. We will update you on the current processing activity at the Backlog Elimination Centers, the USCIS Service Centers and the complex issues surrounding visa retrogression and immigrant visa availability.

Liane Hicks Cooney

Liane Hicks Cooney is the managing attorney in Berry , Appleman & Leiden's Washington DC/Tysons VA office. She concentrates on matters involving nonimmigrant and immigrant business visa practice, as well as advising companies in complex immigration practice and policy concerns.

Ms. Cooney has over ten years experience exclusively practising US immigration law with firms in the US and UK , focusing on business immigration and consular processing. Prior to joining Berry , Appleman & Leiden, Ms. Cooney established and developed a new US immigration practice within the UK 's largest corporate immigration and nationality practice. She advised corporate entities in a range of industries on US immigration matters relating to treaty company registrations and treaty employee visas, intracompany transfers, business visitors, specialty occupation professionals and EB-1 immigrant visa petitions. Ms. Cooney managed processing of nonimmigrant and immigrant visa applications at the US Embassy in London . She provided advice to AILA lawyers on London processing, and was a regular speaker at conferences and seminars (Confederation of British Industry, ECA International, London Business School , and numerous in-house seminars for clients).

Ms. Cooney received her B.A. with Honors in Sociology and Political Science at the University of North Carolina , Chapel Hill in 1979. She received her J. D. from George Washington University , National Law Center , Washington , D.C. in 1987. Ms. Cooney is a member of the Texas and Virginia State Bars and AILA.  

Stacy Shore

Stacy Shore is an associate attorney in Berry , Appleman & Leiden's Washington , DC / Tysons , VA office. Ms. Shore handles an array of business immigration matters, including labor certification applications, immigrant visa petitions, applications to adjust status and consular processing, as well as nonimmigrant visa petitions for intracompany transferees, specialty occupations, and individuals of extraordinary ability.

Prior to joining our firm, Ms. Shore was an associate with a global immigration firm in its Washington , DC , office handling employment-based immigration matters for major international companies. Ms. Shore also handled family-based immigration cases and naturalization applications. While in law school, Ms. Shore clerked at the U.S. Immigration Court in Philadelphia .

Ms. Shore is an active member of the American Immigration Lawyers Association.

Ms. Shore received her B.A. in Sociology from Brandeis University in 1993. She earned her J.D. from Temple University 's Beasley School of Law in 1999, where she served as a member of The Political & Civil Rights Law Review , and as Managing Editor of the law school newspaper, Class Action . Ms. Shore is licensed in Pennsylvania and the District of Columbia .
