Retaliation Claims – The New Wave In Employment Litigation

Sponsored by:

Virtually every employment lawsuit today includes a claim for retaliation – and workers are regularly winning on these claims (even when the underlying claim of discrimination or harassment is rejected). Couple this trend with the U.S. Supreme Court's recent decision in Burlington Northern & Santa Fe Railway Company v. White and employers should be very afraid .

This audio conference will discuss the new standard adopted by the high court this past June for evaluating retaliation claims under Title VII of the Civil Rights Act of 1964 (and, possibly, other federal employment laws). In addition, this presentation will help employers identify likely retaliation situations and craft a strategy for dealing with an employee without spawning a retaliation lawsuit. You won't want to miss this important audio conference!

Learning Objectives:

  • Analyze what constitutes “retaliation” under employment laws, including the proper standard for evaluating whether certain conduct amounts to an “adverse employment action”
  • Discuss employers' responsibility for conduct of supervisors and co-workers after the new Supreme Court ruling
  • Identify policies, training techniques and investigation procedures that resolve complaints and avoid litigation Address how employers should handle employees after they file a complaint

Who Should Attend?

  • Human Resource Professionals
  • Executives
  • Team Managers
  • Supervisors
  • Line Managers

Mr. Fox defends employers in employment law litigation all across Texas, including successfully defending the first male on male sexual harassment case tried to a jury in Texas. His most recent jury trials include no liability verdicts for a convenience store chain in an age/race discrimination and wage hour case (Amarillo federal court), a trucking company in a workers compensation retaliation case (El Paso state court), and a financial services institution in an age discrimination case (Dallas federal court).
