Employee Free Choice Act: What It Is and Proactive Strategies for Employers

With a nearly filibuster-proof Democratic majority in the Senate, the Employee Free Choice Act (EFCA) seems likely to pass early in the Obama administration. The EFCA might constitute the biggest victory for unions and employee organizing efforts in over half a century. The EFCA would amend the National Labor Relations Act to change the technical procedures by which unions are recognized in the workplace. The net effect of these procedures would make it easier for unions to organize workers, establish themselves as exclusive bargaining representatives for workers and negotiate more favorable collective bargaining agreements. The proposed EFCA also increases substantially the penalties for employers who discharge or discriminate against employees engaging in organizing efforts.
This presentation will assist employers in learning the risks that the EFCA could pose to them and taking proactive steps toward meeting these risks by creating a positive work environment and cooperation between employees and management.

of discrimination, grievances and lawsuits. John has taken over a dozen employment lawsuits to trial in his career, involving claims of age, disability,
race, and sex discrimination; sexual harassment; breach of contract; negligent retention; and violations of noncompetition agreements.
John is a prolific author and speaker. For example, he authored nine editions of Minnesota Employment-at-Will Law, an extremely valuable guide for
employment lawyers, and has taught employment law at Hamline University School of law on an adjunct basis.
Beginning at 3M, John has developed a nationally recognized expertise in workplace violence and related security consulting. He continues this work,
acting as General Counsel for Business Security Advisory Group, a national group of former chief security officers who now provide security consulting
services.
John possesses a Juris Doctor Degree from Georgetown University Law Center, Washington D.C., where he graduated magna cum laude and Order of the Coif in
1986. He also has a Bachelor of Arts Degree from Georgetown University, Washington D.C., graduating magna cum laude in 1981. In between college and law
school, John spent a year studying at the University of Chicago Divinity School and a year as a legal secretary!
