Electronic Privacy Policies


Electronic communication is ubiquitous. Email, company intranet, access to the internet, electronic bulletin boards, Facebook postings and employee participation in other forms of social media all present challenges for employer. Can an employer be liable for failure to monitor an employee's internet usage when that employee uses the employer’s equipment to access to a child pornography site? Can employers by sued by employees based upon messages left on employer-sponsored electronic bulletin board? What about employees using logos and uniforms on their own social networking sites?

Employers have responded to these threats by instituting policies limiting use of email to business purposes and by monitoring employees’ email usage. How can employers protect themselves legally? What have the courts said about employees’ privacy rights in these situations? What controls can an employer legally employ when employees use employer owned and provided equipment for electronic communications? This seminar will deal with these and other questions about electronic communications.
