Labor and Employment Law: Six Timely Trends

December 4 , 2008
1:30 - 3:00 PM Eastern Time
|
On September 25, 2008, President Bush signed into law the ADA Amendments Act of 2008. The Act overturns several landmark Supreme
Court decisions and uproots many best practices in disability law. With the Act going into effect on January 1, 2009, employers
must immediately familiarize themselves with the amendments and update their practices.
This presentation will address the changes to the ADA on paper and in practice. We will discuss the key provisions of
the Act and compare what we understood in the past to what the future of ADA administration holds. Finally, we will offer
practical tips for handling the likely uptick in reasonable accommodation requests by employees and applicants.
|
Learning Objectives:
- Discuss the history and policy behind the ADA Amendments Act, which shed light on how it will be interpreted by the EEOC and courts.
- Understand how the Act increases the number of employees protected by the ADA, and what that means for practitioners.
- Describe how the Act simultaneously broadens and narrows the claims of employees and applicants “regarded as” disabled.
- Receive practical advice on administering today’s disability laws.
