HEADLINES PRODUCE CHANGE:
OSHA’s Updated (and Improved?) Construction Crane and Derrick Standard


A proposed update to (what is widely perceived to be) an outdated crane and derrick standard has come on the heels of a series of high profile construction accidents in New York City and Houston. Four years after a consensus document arose from the 23-member federal Cranes and Derricks Negotiated Rulemaking Advisory Committee, the long-awaited proposed rule was finally published by the Occupational Safety and Health Administration (OSHA) on October 9, 2008. While the future of this proposed standard is unknown, OSHA’s focus and interest in this topic are not. In this seminar, we will examine the history and content of the new crane and derrick standard and help employers design strategies to minimize liability and meet the regulatory challenges ahead.

Baker Hostetler

Cole Wist is a partner in the Denver office of Baker Hostetler, a national law firm based in Cleveland. He counsels clients on occupational and mine safety and health law, including OSHA and MSHA inspections, litigation, and liability prevention. He defends employers in accident and disaster investigations and related litigation matters.

Cole is from a coal mining family in western Colorado and worked in the North Fork Valley’s mines while earning his education. He is a graduate of the University of Denver and Georgetown University Law Center.

In addition to his occupational safety and health practice, Cole also engages in a complex civil litigation practice, which includes handling cases related to toxic torts, product liability and insurance. He has substantial jury trial and arbitration experience in federal and state courts in Colorado and across the country.

Cole is a national speaker and author on liability prevention and crisis management for employers

Michael A. Sutton, PE, MSME is the founder and managing partner of Accident Research Specialists, PLLC, a forensic engineering firm headquartered in Cary, North Carolina. Michael and his company investigate a variety of accidents and failures involving vehicles, machinery, and the built environment.

Over the last 20+ years, Michael has investigated over 2000 events, providing engineering analysis, accident reconstruction, and expert testimony. His expert testimony enjoys a strong reputation in both state and federal courts throughout the United States.

A graduate of North Carolina State University, Michael has a Bachelor of Science Degree in Mechanical Engineering and a Masters in Engineering. He is also a registered Professional Engineer in multiple states.
